Allegations Surface Against Montenegrin Gynecologist Following Assault Claims

A twenty-five-year-old woman has accused gynecologist P.J. of sexual assault, leading to his arrest in Podgorica, Montenegro. The woman reported that after a medical examination on October 10, 2023, the doctor allegedly kissed her on the neck, grabbed her buttocks, and made inappropriate comments. Following her complaint, the gynecologist was taken into custody but has since been released to defend himself while investigations continue.

The case was reported to authorities through the non-governmental organization Prima, which assisted the victim in filing a formal complaint. According to Prima, the woman approached them the day after the examination to recount her experience of alleged sexual harassment. The organization stated that they accompanied her to the police station where she reported the incident to an inspector specializing in violent and sexual crimes.

In a statement, Prima emphasized the professionalism of the investigating officer, which they believe is crucial for maintaining victim trust in the justice system. The case has now been transferred to the Basic State Prosecutor’s Office in Podgorica, which has classified the allegations as a criminal act of unauthorized sexual acts.

Despite the serious nature of the allegations, the prosecutor’s office has not publicly detailed the basis for the decision to release the doctor. The situation has raised questions regarding the response from medical professionals following the report. According to Prima, when the victim sought medical assistance at the Clinical Center of Montenegro (KCCG) later that evening, two out of three on-call gynecologists initially refused to perform necessary procedures as directed by the prosecutor. The gynecologists complied only after police intervention, which demanded a written explanation for their refusal.

The Ministry of Health of Montenegro has acknowledged the unfolding situation and expressed the need for a thorough investigation. In a statement, the Ministry emphasized the importance of patient safety and the ethical conduct of healthcare professionals, asserting that maintaining public trust in the healthcare system is paramount.

On the following day, the Commission for Ethical Issues and Deontology of the Medical Chamber of Montenegro, of which P.J. is a member, released a statement. The Commission clarified that they respect the presumption of innocence and would not comment on the legal aspects of the case. However, they noted that should the allegations be substantiated, the described actions would constitute significant violations of medical ethics and patient rights.

The incident has sparked discussions around institutional responses to allegations of sexual violence in healthcare settings. Prima highlighted the psychological impact that sexual violence has on victims and stressed that institutional responses should not exacerbate their trauma.
