Man, 75, Breaches Non-Molestation Order After Violent History

A 75-year-old man, Stewart John Nicholl, has breached a Non-Molestation Order by visiting his ex-wife’s address in Islandmagee on April 12, 2023. This incident follows a previous conviction where he received a five-month prison sentence for assaulting his former wife, who he threatened to kill in a prolonged and violent episode.

In January, Nicholl pleaded guilty to multiple charges, including assault and making threats to kill. The court heard harrowing details of the incident, where Nicholl slapped and kicked his wife, leaving her on the floor for two hours. During this time, he told her: “I am going to kill you and it is going to be done slowly over a few days.” The victim, who is in her 70s and uses crutches, managed to call the police using an Apple Watch after he took her mobile phone to prevent her from seeking help.

During the earlier court proceedings, the prosecuting attorney recounted how Nicholl had pushed his wife to the ground and physically assaulted her. The victim described the ordeal as one of constant verbal abuse and intimidation, which culminated in her being unable to get to her feet due to her mobility issues. The distressing situation ended only when she was able to lock herself in a bathroom and summon help.

In light of Nicholl’s actions, District Judge Nigel Broderick condemned the abuse as “despicable,” emphasizing that his wife should feel safe in her own home. The judge noted that the defendant demonstrated a troubling tendency to minimize his responsibility for the violence, suggesting a distorted perception of the events that transpired.

The recent breach of the Non-Molestation Order was captured on doorbell footage, which showed Nicholl at his ex-wife’s property. His defense attorney argued that Nicholl was unaware of the order’s specifics, claiming he was there to retrieve tools from a garage. However, Judge Broderick expressed concern over Nicholl’s presence at the property, stating that it would be alarming for the victim.

As a result of the breach, Nicholl has been placed on probation for one year and required to complete 75 hours of community service. Additionally, a two-year Restraining Order has been issued to further protect the victim. The case has highlighted ongoing issues of domestic violence, with advocates calling for increased measures to support victims and prevent further incidents.
